Investor-State Dispute Settlement (ISDS)
overview
Shin & Kim’s ISDS Practice is Korea’s leading practice advising on ISDS matters. Korea has entered into more than 120 bilateral investment treaties and free trade agreements with countries around the world. As a result, Korean investors may institute ISDS proceedings (i.e., investment arbitration) against most sovereign states in the world. Conversely, the Korean government is finding that it is required to respond to an increase in ISDS proceedings filed by foreign investors from around the world.
Our team of experts understands Korea’s intricate web of investment treaties better than anybody else in the world. We help the clients to navigate the possible avenues of recourse available through ISDS for issues that domestic litigation or commercial arbitration cannot effectively resolve.
