First Paid-in Capital Increase by a Listed Company Specializing in Infrastructure Investment in Korea

The issuer Macquarie Korea Infrastructure Fund is the only listed Korean company specializing in infrastructure investment under the Act on Public-Private Partnerships in Infrastructure. Macquarie Korea Infrastructure Fund became the first listed company specializing in infrastructure investment in Korea to complete a paid-in capital increase, which was worth approximately KRW 147.2 billion.

There were legal hurdles due to conflicts between securities regulations and fund-advertising regulations as well as differences between the issuer’s stock price and the issue price of new stock calculated under relevant regulations. Despite these complications, Shin & Kim attorneys successfully completed the paid-in capital increase by providing expert legal advice.
