Autumn Seminar of the Korean Competition Law Association- Attorney Tak-Kyun Hong

Attorney Tak-Kyun Hong at Shin & Kim gave a presentation under the title of "Issue of Substantiation of Unfair Collaborative Act- Typology of Indirect Evidence" at the 2010 Autumn Seminar of the Korean Competition Law Association held on Nov. 5, 2010. Specifically, Attorney Hong gave a presentation on the results of research on domestic and overseas examples or documents about the necessity for the typology of various types of evidence needed for substantiating unfair collaborative acts through indirect evidence, sharp distinctions of the evidential value of each type of evidence, etc., and participants and panelists at the seminar had heated discussions on such topics. An issue of how much indirect evidence is needed to substantiate an unfair collaborative act is important not only to executive authorities including the Fair Trade Commission, the prosecution and the court, but also to companies under investigation of unfair collaborative acts. In this vein, Attorney Hong's presentation as above is expected to lead to more discussions on the recognition of unfair collaborative acts, and to the formation and application of rigorous and general standards on the recognition.
