Shin & Kim Co-Hosts Seminar entitled “Amendments to the Defects Provisions of the Act on Ownership and Management of Multi-Dwelling Buildings, Proposed Countermeasures to Amendments...

 

On June 19, 2013, Shin & Kim co-hosted with the Korea Housing Association a seminar entitled “Amendments to the Defects Provisions of the Act on Ownership and Management of Multi-Dwelling Buildings, Proposed Countermeasures to Amendments, and Recent Trends in Precedents on Liability for Sales Advertisements for Multi-Dwelling Buildings”.

 

In the first part of the Seminar, Shin & Kim’s senior partner, Mr. Jae-Yun Yun, gave a presentation on the history of the Act on Ownership and Management of Multi-Dwelling Buildings (the “Multi-Dwelling Buildings Act”) and the Housing Act with respect to liability for defects, the various structures of liability claims, and the amendments made to the Multi-Dwelling Buildings Act and Housing Act since June 18, 2013, and then proposed countermeasures to such amendments. In the second part of the Seminar, Mr. Seung-Soo Lee gave a presentation on the court precedents concerning issue of constructors’ liability for defects, the courts’ criteria for terminations or cancellations of purchase agreements, and the determination of liability for and calculation of damages.

 

The Seminar was well-received by the members of the construction industry and related industries who were in attendance, and many in the audience commented that the Seminar was very timely in discussing the “hot” issues currently prevailing in the industries and provided valuable legal advice to working-level employees.

Mr. Yun Jae-Yun, a former judge, joined Shin & Kim in 2012 after serving in his final post as the chief of the Chuncheon District Court. Currently, Mr. Yun leads a team specializing in construction and real estate disputes. Mr. Yun also authored “Laws related to Construction Disputes,” and has been lecturing at the Judicial Research & Training Institute, the Korean Bar Association and other institutions.

 

Mr. Seung-Soo Lee’s main practice areas focus on redevelopment and reconstruction projects, apartment sales advertisements, disposals, management, and real estate mortgage trusts. Drawing on his solid base of litigation experience, Mr. Lee has authored numerous articles on construction and real estate disputes.
