Attorney Yoon-Hee Kim Speaks at the Working Council for Information Sharing

Yoon-Hee Kim, a partner of Shin & Kim, gave a presentation entitled “The Hague Convention on the Taking of Evidence Abroad” at the Working Council for Information Sharing arranged by the Korea Deposit Insurance Corporation (KDIC) and held on December 19, 2014. The Council consists of government institutions responsible for tracing property and collecting taxes, including the National Tax Service, the Korea Customs Service, the Seoul Main Customs, the Supreme Prosecutor's Office, and the Seoul Government Office.  Ms. Kim, a vice-chair of Shin & Kim’s Japanese practice group and overseas litigation counsel to KDIC, lectured on the Hague Convention based on her domestic and overseas litigation experience.


As a manifestation of international judicial collaboration, the Hague Convention on the Taking of Evidence Abroad, together with the Hague Convention on Service Abroad, is the primary international treaty pertaining to civil and commercial litigation. Following Korea’s accession in 2009, the Hague Convention on the Taking of Evidence Abroad entered into force in 2010. Ms. Kim emphasized that while Korea has been reluctant in relying on evidence presented by the commissioner, considering that capital flight to overseas is increasing, it has become necessary to study various overseas litigation regimes and actively seek international civil collaboration based on the Hague Convention on the Taking of Evidence beyond international criminal collaboration.
