Sangdon Lee, a partner of Shin & Kim, delivered a keynote presentation entitled “Implications of the U.S. v. Bazaarvoice, Inc. Case: Prohibition of Merger between Rating and Review Platform Companies” at the Autumn Symposium of the Korean Association of Fair Economy held on November 6, 2015.
Mr. Lee introduced the decision rendered by the U.S. District Court, Northern District of California in the U.S. v. Bazaarvoice, Inc. case, which held that the merger of Bazaarvoice, Inc. and PowerReviews, Inc., the two largest rating and review companies in the market, would likely have anti-competitive effects. Mr. Lee analyzed various issues related to the merger, including the criteria to determine the likelihood of entry into a dynamic market and probative value of customers’ statements and post-merger market conditions, by comparing them against similar cases brought before the Korea Fair Trade Commission.
