Mr. Hyung-Soo Kim is a partner at Shin & Kim. Mr. Kim’s main practice areas include various administrative proceedings (taxes, fines, charges, and suspension of business), labor-management proceedings, and criminal litigation cases (property crimes such as embezzlement and breach of trust, and other crimes including bribery and corruption in the defense industry).

In various proceedings on the imposition of fines and charge, and in many administrative proceedings seeking the suspension of enforcement of punitive measures such as the suspension of business, Mr. Kim has successfully persuaded the court to declare the measure in question void or to render a decision to suspend the enforcement of such measure. In a case about an urban renewal project, Mr. Kim succeeded in defending his client against a claim to revoke the management disposal plan, and also in a case where a revocation was sought for a measure that refused permission to build waste disposal plants and funeral halls, Mr. Kim succeeded in persuading the court to revoke the measure.

As for criminal litigations, Mr. Kim has extensive experience of handling various cases of fraud, embezzlement, breach of trust, bribery and corruption in the defense industry under acts on the aggravated punishments, and also has experience of successfully having the court to render an acquittal or probation decision.

• Represented and won a lawsuit to cancel the disposition of refusal of the declaration of construction commencement for Dow Technology’s Jukjeon Data Center in Yongin, Gyeonggi-do, Korea, and the disposition of refusal of the declaration of construction commencement for a housing development project in Gwangjin-gu, Seoul, Korea

• Represented a lawsuit to cancel restrictions on bidding qualifications for various defense companies such as Poongsan and Samdeok Commerce
• Represented and won a lawsuit to cancel the disposition to revoke direct production confirmation for Younghyun Information & Communication
• Advised Hyundai Rotem on various contracts with the Defense Acquisition Program Administration and public tenders of public organizations
• Represented a lawsuit against Hanwha Ocean (formerly Daewoo Shipbuilding & Marine Engineering) in connection with the peak wage system
• Advised LG CNS on confirmation of winning bidder status with the Public Procurement Service
• Represented a criminal fraud case involving the receipt of illegal subsidies by a PV company
• Represented and won an order of remand from the Supreme Court in a case to cancel the imposition of customs duties on Youngone Corporation

• Represented HD Hyundai Oilbank’s lawsuits to cancel the disposition of recovery of petroleum import levy, the imposition of customs duties, etc.
• Represented a lawsuit to cancel the disposition of subsidy withdrawal related to emission reduction devices for SK Energy, Hyundai Mobis, etc.
