Kiyoung Nam is a senior foreign attorney at Shin & Kim who concenturates on eDiscovery, internal investigation, forensic investigation, data management, and data privacy.

He has served clients in the management of data in litigation, arbitrations, investigations, and regulatory reponses. His expertise covers a range of activities across the EDRM phases, including textual analysis for cross boarder matters. He has led and directed multiple computer forensic investigations for global companies and reported on findings. He also advises clients on data collection, transfer and data privacy risks in Korea involving PIPA.

He has served as subject-matter expert in helping customize eDiscovery technology solutions to conduct sophisticated data analyses, optimize search methodology, and design custom technical procedures and reporting.

• Participated as a digital forensics and eDiscovery expert for a major Korean battery manufacturer in its response to a U.S. ITC’s investigation and provided comprehensive advice on digital forensics and eDiscovery in relation to data retention procedures and deletion circumstances.
• Advised a number of Korean companies listed in the U.S. on eDiscovery in their response to requests for documents from the U.S. Securities and Exchange Commission and Department of Justice.
• Advised on eDiscovery in response to requests for information from the European Commission and the U.S. Federal Trade Commission in relation to two M&A deals involving a global shipbuilder and a global airline.
• Advised a number of Korean IP companies on eDiscovery in their response to patent infringement lawsuits in the U.S.
• Advised on digital forensics and eDiscovery in response to internal investigations of a number of Korean and global companies, accounting fraud investigations against Korean companies, as well as KFTC investigations.
• Conducted digital forensic investigations related to the leakage of trade secrets and other confidential information of a number of Korean and global companies.
• Advised on the advancement of the privacy policy and system of a global automobile manufacturer.
• Conducted fact-finding investigations based on digital forensics and eDiscovery in shareholder disputes of a number of Korean and global companies.
