Foreign Attorney Arie Eernisse Wins Prestigious Speaking Slot for “New Voices” Panel at CIArb Asia-Pacific Regional Conference

 

Shin & Kim Foreign Attorney Arie Eernisse was selected to present on the “Next Generation: New Voices” panel at the Chartered Institute of Arbitrators (“CIArb”) Asia-Pacific Regional Conference in Singapore on 23 April 2019.

Arie spoke on the timely issue of whether arbitral institutions and members of the arbitral community should take a more proactive approach to promoting the publication of arbitral awards. He explained that the publication of awards is currently more the exception than the norm in international commercial arbitration due to the “opt-in” structure of most institutions’ rules, but recent developments such as the ICC’s amendment on 1 January 2019 of its “Note to Parties and Arbitral Tribunals on the Conduct of the Arbitration” may signal a general trend toward more publication. Similarly, in the case of investment arbitration, where award publication is more common but still not universal, ICSID’s recent rule amendment process has revealed that member states and other stakeholders increasingly recognize the need for more transparency, and this may translate into even greater acceptance of publication of investment arbitration awards.

For example, at this conference, CIArb introduced its new Guidelines for Witness Conferencing in International Arbitration.
