Mr. Gibum Park is a partner at Shin & Kim, who is widely acclaimed for his seasoned expertise and winning arguments based on his meticulously built logic supported by an in-depth knowledge in the Civil Act, Criminal Act, and Corporate/Finance Acts. Mr. Park is a member of the Tax Professional Group in Shin & Kim, but his practice area extends beyond tax issues, and covers accounting, customs, inheritance and gifts, corporate laws, Capital Markets Act, and foreign exchange.
Mr. Park passed the certified public accountant examination during his studies of international relations at Seoul National University and started his career at an accounting firm. Upon completing his course at the Judicial Research and Training Institute, he has been a highly sought-after tax attorney. He recently completed his taxation course at NYU LL.M., one of the top-tier courses on international tax and the U.S. tax code, gaining a stronger edge as a tax expert with a broad knowledge base on the U.S. tax code.
Mr. Park pools from his deep understanding in the industry and his experience in multiple sectors to provide opinion that is essential to the client’s decision making, and market commentators remark that he provides a viable and practicable solution to the clients’ issues.
In litigations, he represented one of the top global firms in Korea in a case against charges of violation of the Act on External Audit of Stock Companies and won the prosecutor’s acquittal by presenting a legal logic that blended in the Act on External Audit of Stock Companies, Criminal Act, Commercial Act, Framework Act on National Taxes and accounting theories, and won numerous tax lawsuits including cases seeking cancellation of gift tax (profit gains issues, taxation of constructive gift for nominal trust) imposed to major shareholders of listed companies and SMEs. He also won a case on cancelling customs tax on goods imported from Korean subsidiaries which was imposed to offshore global firms.
In the legal advisory service sector, he developed a legitimate logic on issues of tax evasion and fictitious tax invoices in response to the NTS’ tax investigation and investigation regarding alleged violations conducted against multiple listed companies, and won a not-guilty decision from the court which ordered the NTS to withdraw the taxation. Additionally, jointly with U.S. law firms, he provided comprehensive advice on business in Korea and adjustment of governance of global corporates, and provided general advice to a large firm on tax laws, corporate laws, civil and criminal issues, foreign exchange laws regarding the winding up of a foreign business site. He also advised the management of the large firm on violation of foreign exchange laws and reporting duties for offshore financial account.
