AdvisorIntroduction
Mr. Hyunchul Kang is an Advisor at Shin & Kim, and provides advisory services primarily in the areas of capital markets investigations and enforcement matters, corporate and general criminal matters, anti-corruption and internal investigations, and anti-money laundering.
Mr. Kang is an investigation and enforcement expert with approximately 23 years of experience at the prosecution service, the Financial Services Commission (FSC), and other government authorities since beginning his career as a prosecution investigator in 2002. He handled a wide range of investigations, including anti-corruption and corporate criminal matters, while serving at the Special Investigation Division II and Financial Investigation Division of the Seoul Central District Prosecutors’ Office, the Foreign Affairs and Public Security Division of the Busan District Prosecutors’ Office, the Prosecution Division of the Ministry of Justice, the Investigation Division of the Seoul Eastern District Prosecutors’ Office, and the Investigation Division of the Western Branch of the Busan District Prosecutors’ Office.
In particular, Mr. Kang served for approximately two years and nine months as an analyst at the Korea Financial Intelligence Unit (KoFIU) under the FSC, where he developed extensive practical expertise in analyzing Suspicious Transaction Reports (STRs) and Currency Transaction Reports (CTRs) filed by financial institutions, as well as an in-depth understanding of the anti-money laundering framework. In recognition of his contributions to anti-money laundering efforts during his tenure at KoFIU, he received a Commendation from the Chairman of the Financial Services Commission (Minister-level) in 2015.
Mr. Kang subsequently served for approximately two years as Head of an Investigation Team at the Capital Market Investigation Unit of the FSC, where he investigated various unfair trading cases in the capital markets, including market manipulation and fraudulent trading. He handled a wide range of cases involving violations of the Financial Investment Services and Capital Markets Act, including a fraudulent trading case involving fractional investment in artworks and virtual assets, a stock manipulation case related to the stock price collapse triggered by SG Securities, and market manipulation and fraudulent trading cases involving zero-capital M&A transactions. Through these investigations, he gained extensive hands-on experience with the collaborative framework among the FSC, the Financial Supervisory Service, the Korea Exchange, and investigative authorities, further strengthening his expertise in financial and securities investigations.
